On August 19, 2008, the
Centers for Medicare & Medicaid Services ("CMS") issued
the Hospital Inpatient Prospective Payment Systems final
rule for discharges in Fiscal Year 2009 ("2009 Final
Rule"). While technically speaking, it may not be
called the Stark II, Phase IV regulations, what it lacks
in name it undoubtedly makes up for in substance.
