Biography
Stacey P. Klein is an associate at Garfunkel Wild,
P.C., which she joined in 2011. She is a member of the
firm’s Health Care and Compliance and White Collar
Defense Practice Groups, which
advise clients on a host of business, regulatory,
compliance and transactional matters.
Prior to joining Garfunkel
Wild, Ms. Klein previously worked for Proskauer Rose LLP
as an associate in the Tax, Employee Benefits, Executive
Compensation and ERISA Litigation group, where she
advised both tax exempt and for profit clients regarding
employee benefits and executive compensation issues,
including compliance with ERISA, the Internal Revenue
Code, Securities and other laws affecting employee
benefit plans and compensation arrangements, including
Health Care Reform.
Ms. Klein has analyzed a wide range of complex ERISA
fiduciary and prohibited transaction issues and has
advised clients with respect to their pension plans,
health and welfare plans, and fringe benefit policies,
as well as their IRAs. Additionally, Ms. Klein has
experience counseling clients regarding compliance with
Code Section 409A and Intermediate Sanctions, the
structuring of corporate transactions and the
remediation of abusive tax shelters.
Ms. Klein
also is experienced litigating controversies regarding
tax and employee benefit issues and resolving matters
with the IRS and U.S. Department of Labor.
Among her
accomplishments, Ms. Klein successfully abated all
penalties in connection with an IRS tax and penalty
assessment, negotiated a record low offer in compromise
with the New York State Department of Taxation and
Finance, and won a multimillion dollar arbitration award
for an employee benefit plan against a large insurance company.
Ms. Klein received her B.A.,
summa cum laude, from Barnard College and her J.D. from
Columbia Law School, where she was a Harlan Fiske Stone
Scholar.
